Administration Releases 2013 Regulatory Agenda UpdateJuly 9, 2013
On July 3, 2013, the administration made available online its Spring 2013 Update to the Unified Agenda of Regulatory and Deregulatory Actions, which is the administration’s regulatory roadmap for the coming year. Pursuant to Section 4(b) of Executive Order 12866, all covered agencies and departments are required to publish a regulatory agenda that outlines their plans to publish or notices of rulemakings or the final rules themselves. Section 4(b) reads as follows:
“Unified Regulatory Agenda. For purposes of this subsection, the term ‘agency’ shall also include those considered to be independent regulatory agencies, as defined in 44 U.S.C. 3502(10). Each agency shall prepare an agenda of all regulations under development or review, at a time and in a manner specified by the Administrator of OIRA. The description of each regulatory action shall contain, at minimum, a regulation identifier number, a brief summary of the action, the legal authority for the action, any legal deadline for the action, and the name and telephone number of a knowledgeable agency official. Agencies may incorporate the information required under 5 U.S.C. 602 and 41 U.S.C. 402 into these agendas.”
The Spring 2013 Update includes action’s ranging from the U.S. Small Business Administration’s (SBA’s) Small Business Size Standards for Manufacturing (which is in the proposed rule stage) to the U.S. Environmental and Protection Agency’s (EPA’s) Hazardous Waste Requirements for Retail Products; Clarifying and Making the Program More Effective (which is in the pre-rule stage).
