NLRB Poster Requirement Temporarily on Hold

April 19, 2012

The DC Circuit Court of Appeals has temporarily enjoined the NLRB’s rule requiring that employers post an NLRB poster regarding unionization rights. The rule, which had been scheduled to take effect on April 30, 2012, will not take effect until the legal issues are resolved. There is no new deadline for the posting requirement at this time.

A South Carolina federal trial court has ruled that NLRB did not have the authority to require the poster.  The DC U.S. District Court ruled that it did.
