AA017956On Aug. 13, 2015 NSBA held an issue briefing teleconference for members to discuss proposed overtime regulations which could more than double the salary threshold for paying overtime from $23,660 to $50,400 – a whopping 113% increase.

The call featured labor expert and attorney Michael Eastman, who currently serves as VP for Public Policy at the Equal Employment Advisory Council, and is recognized as one of the leading experts on overtime regulations within the D.C. beltway and beyond. The call focused on the overtime proposal and how it could impact small firms across the U.S. Also on the call was NSBA President and CEO Todd McCracken who gave a summary of the proposed rule and NSBA VP of Government Affairs Jody Milanese who provided a call to action to the call participants.

As background, on July 6, 2015, the Obama Administration proposed new overtime rules which will massively increase the salary threshold below which all employees must be paid overtime. Additionally, and perhaps even more concerning, the proposal seeks comment on the so-called “duties test”, opening the door to changes to be adopted in a final rule.

In addition to the detailed analysis and avenues to get engaged offered by the guest speakers, there was a healthy question-and-answer session in which Mr. Eastman responded to questions on how the proposal deals with employees who travel for business purposes; changes in treatment of outside sales forces; what the estimated average small-business cost would be of the rules; and much more.
